A legal victory! The Court found the H.P. Board’s approval of the project did not contain sufficient findings and sent the matter back to the H.P. Board for further hearing.

After Joe’s tragic death, we substituted Joe’s estate and his wife (as co-owner of their home) as the new plaintiffs for this appeal. The Court rejected the developer (LB Atlantic LLC) and the City of Portland Historic Preservation Board’s motions to dismiss the appeal on the grounds that only Joe had legal standing to appeal. Read their motions and the Court’s order here. Instead, the Court remanded the matter back to the Historic Planning Board to make further findings to substantiate their approval of the development.
